Michigan Health Care Claims Act Litigation Update

March 16, 2012 – The Self-Insurance Institute of America, Inc. (SIIA) this week filed a legal brief in opposition to a motion by the state of Michigan that the association’s lawsuit challenging the state’s recently-enacted health care claims tax be dismissed. SIIA contends the law is preempted by the Employee Retirement Income Security Act (ERISA).

Members can access the brief through the SIIA website by clicking here. A hearing on this case has been scheduled for June 7, 2012.

This litigation has been made possible by the generous financial contributions of more than 40 members to the association’s Legal Defense Fund. Corporate contributions continue to be collected on-line at www.siia.org/legaldefense.
